The Human Tissue Act sets out the legal requirements surrounding the removal of tissues from a dead person. In essence, tissues can be removed for transplant or therapeutic purpose if:

  1. the dead person has expressed a desire to have his/her tissues removed, or
  2. neither the dead person, nor their family have expressed a desire not to have tissues removed, or
  3. the dead person's wishes are unknown and a family member cannot be located after making reasonable inquiries.

If the dead person's circulatory functions are being maintained artificially, two doctors must certify that the person is dead by brain death criteria.
